The United States Government has granted itself a 45-day delay to review Upper Big Branch documents that it has kept hidden now for over eight years—documents the U.S. Government’s Department of Justice (DOJ) had asked the U.S. Government’s Judge to delay reviewing for 90 days. The 45-day delay the U.S. Government Judge granted to the U.S. Government DOJ is a delay just to prepare to review the documents, not to actually review them or to release them. My last update regarding my case status, ie my continuing efforts to get my “misdemeanor” conviction invalidated, said that the Department of Justice (DOJ) had decided not to handle my filings in “Mitch McConnell Land” ie Eastern Kentucky but rather in Ohio. My attorneys did not hear directly from the Ohio US Attorney’s office until yesterday, June 5, and as expected, when they called they said that they would seek yet another delay. The Don Blankenship for U.S. Senate campaign has officially started it’s petition drive to gain ballot access for the 2018 general election in West Virginia as the nominee for the Constitution Party. Cabell and Kanawha County Clerks have already approved the Official Credentials form that provides authorization to solicit petition signatures for minor party candidates. Official requests for the credentials have been sent to all fifty-five county clerks. Don Blankenship releases the following statement: The Department of Justice (DOJ) informed my attorneys on Friday that they have now changed their mind and have decided that my legal filings, to reverse and invalidate my misdemeanor conviction, will be handled by the Southern District of Ohio DOJ office and not by the Eastern District of Kentucky ie by McConnell prosecutors. On Monday, May 21, 2018, attorneys for Don Blankenship filed a motion with the court to release even more records that the Mine Safety and Health Administration (MSHA) wants to keep secret. This new filing by Don’s attorneys follows a motion previously filed to vacate Don’s conviction based on the mountains of evidence improperly withheld from him at trial. Following that filing the current U.S. Attorney discovered even more relevant documents that MSHA had never provided to Don’s defense.
