Don Blankenship’s attorneys have filed their response to a government motion which opposed Blankenship’s original motion that his misdemeanor conviction be invalidated. The government’s motion was filed November 16th. Blankenship’s motion, filed Friday November 30th, once again asks the court to invalidate his misdemeanor conviction on the basis that it was obtained through prosecution misconduct. The government, as was scheduled, filed its motion in opposition to invalidating my conviction on Friday November 16, 2018. Their position was exactly as expected. The Department of Justice is scheduled to file a court motion on Friday November 16th.
